By accessing or using the Bricqs platform (“Service”), operated by Bricqs (“we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Bricqs provides an engagement and gamification platform that enables users to create, manage, and deploy interactive campaigns including quizzes, challenges, leaderboards, rewards programs, and other gamified experiences. The Service includes the web application, APIs, SDKs, and any related tools or documentation.
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
4. Subscription & Billing
Paid plans are billed on a monthly or annual basis as selected at the time of purchase. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing with 30 days' advance notice. If you exceed your plan's participant allowance, overage charges will apply at the rates specified in your plan.
Free trials, when offered, provide full access to the selected plan for the specified trial period. You will not be charged until the trial ends, at which point your subscription will begin unless you cancel beforehand.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Transmit any content that is harmful, threatening, abusive, or otherwise objectionable
- Attempt to gain unauthorized access to the Service or its related systems
- Use the Service to distribute spam, malware, or other harmful content
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated means to scrape or extract data from the Service without authorization
6. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Bricqs and is protected by international copyright, trademark, patent, and other intellectual property laws. Your content remains yours — you retain all rights to the campaigns, assets, and data you create using the Service.
7. Data & Privacy
Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including obtaining necessary consents from your end users for data collection through campaigns created on the platform.
8. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We will endeavor to provide advance notice of planned downtime when possible.
9. Limitation of Liability
To the maximum extent permitted by law, Bricqs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
10. Termination
We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. You may cancel your subscription at any time through your account settings.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated terms on our website with a revised effective date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
